1. Who we are

PayBeta is a Buy Now Pay Later service, a product of Appiawave Technology by Finance 7 Seven (Pty) Ltd, a registered credit provider with the National Credit Regulator of South Africa ("NCR"). References to "we", "us" and "our" mean Appiawave Technology by Finance 7 Seven (Pty) Ltd.

2. Eligibility

To use PayBeta you must be (a) at least 18 years old, (b) a South African resident with a valid South African ID, and (c) able to enter into legally binding contracts under South African law.

3. Credit assessment

Each loan plan is subject to a soft affordability assessment as required by the National Credit Act, 2005 ("NCA"). We may decline a plan or reduce your limit at our discretion. Information you provide during KYC must be accurate and current.

4. Instalment plans

When you create a plan, you authorise us to collect each instalment on its due date using the payment method on file. The full cost of credit, the instalment schedule, interest, fees and total repayable are disclosed in your pre-agreement statement and NCA Form 20 before you accept the plan.

5. Late payments

If an instalment is not collected on its due date we will retry collection. Default administration charges and interest may apply as disclosed in your Form 20 and capped at the rates prescribed by the NCA. Persistent default may be reported to the credit bureaux.

6. Merchants

Approved merchants receive settlement of the gross transaction value net of the disclosed merchant discount rate ("MDR"). Settlement frequency, refund handling and chargeback rights are set out in the merchant agreement signed during onboarding.

7. Acceptable use

You may not use PayBeta to fund unlawful activity, evade credit controls, transact on behalf of a third party without authorisation, or misrepresent your identity. We may suspend or terminate access for breach.

8. Disputes and complaints

Complaints can be lodged with us at support@paybeta.co.za. Unresolved complaints can be escalated to the Credit Ombud or the National Credit Regulator.

9. Changes to these terms

We may update these terms from time to time. Material changes will be notified in-app at least 14 days before they take effect.

10. Governing law

These terms are governed by the laws of the Republic of South Africa and the parties submit to the non-exclusive jurisdiction of the South African courts.
